U.S. EB-5 Immigrant Investment Program Overview
The EB-5 Visa Program provides a pathway for foreign nationals to obtain U.S. permanent residency, otherwise known as Green Card status, through investment.
Investors can secure a green card by contributing either $1 million to a new or existing commercial enterprise, or roughly $800,000 if the investment is in a targeted employment area—areas that face high unemployment or are rural. This investment needs to be liquid, and we as lawyers cannot play any role in directing the source or terms.
This program is designed to stimulate economic growth and job creation in the U.S.. For investors, it represents an opportunity not only for residency but also to contribute to the U.S. economy. However, navigating the EB-5 process involves complex requirements and extensive documentation.
The current processing time varies widely depending on the Investor’s country of origin; from 2-3 years if a “current” country, to 10 years if Chinese.
How It Works
Applicants work with skilled immigration and corporate lawyers to source, trace, and invest the necessary funds.
Applicants work with Regional Centers to fund American Infrastructure.
The Applicants, the Centers, and Legal Professionals work together to meet the government requirements under the program, meeting reporting checkpoints and requirements to best support an eventual Green Card issuance.
